Class Action Against GM Cites Six Vehicle Models with Possible Brake Defect
Last Updated on May 8, 2018
Harris v. General Motors Company
Filed: October 23, 2017 ◆§ 5:17-cv-00180
A lawsuit filed in Texas claims certain Cadillac, Chevy and GMC models contain an alleged brake defect that has reportedly caused at least one crash.
General Motors Company once again finds itself as the defendant in a proposed class action over alleged defects in some of its vehicles. The specific GM vehicles mentioned in the complaint are the 2015-2016 Cadillac Escalade, 2014-2016 Chevy Silverado 1500, 2015-2016 Chevy Suburban, 2015-2016 Chevy Tahoe, 2014-2016 GMC Sierra, and 2015-2016 Chevy Yukon models. According to the plaintiff, the brakes for his 2015 Suburban would “seemingly function without incident the first three to four times they were applied or tapped, but thereafter the brakes would become hard and resists depression or require an increased effort to depress the brake pedal but with no stopping ability.”
The lawsuit alleges GM knowingly sold the above-mentioned vehicle models to proposed class members despite being aware of the alleged brake problem, as evidenced, the case says, by a February 2015 service bulletin sent to dealerships that expressly acknowledged “a customer may comment on a hard brake pedal or that increased effort is needed to depress the brake pedal.” The complaint charges that this service bulletin, as well as subsequent messages sent to dealerships, contained false and/or deceptive information related to curing the alleged brake defect.
According to the complaint, the alleged braking defect found in certain GM vehicles cannot be remedied. To this point, the lawsuit says the plaintiff’s wife was driving their Suburban when a catastrophic brake failure occurred, reportedly causing the woman to crash into another car.
