Saines v. G.L.A. Collection Company, Inc. et al
Filed: March 12, 2018 ◆§ 1:18cv788
G.L.A. Collection Company, Inc. has been named as the defendant in a proposed class action that alleges the debt collector violated federal law by sending a consumer a collection letter that contained 'false threats.'
Indiana
G.L.A. Collection Company, Inc. has been named as the defendant in a proposed class action that alleges the debt collector violated federal law by sending a consumer a collection letter that contained “false threats.” According to the suit, the notice demanded payment on a medical debt and included the following statements:
“The balance due as of the date of this letter is stated above. Due to interest, late charges and other charges that may vary from day to day, the amount due on the day you pay may be greater.”
The suit argues that the defendant knew the man’s balance would not change, and the threat of added interest and fees “is merely a deceptive collection tactic to get the consumer to pay immediately.” In response to these allegedly threatening statements, the plaintiff supposedly “overlooked” the 30-day validation period during which he could dispute his alleged debt and, according to the complaint, was robbed of his rights under the Fair Debt Collection Practices Act (FDCPA).
