Madar v. GC Services Limited Partnership
Filed: November 30, 2017 ◆§ 1:17cv6979
A New York woman has filed a proposed class action lawsuit against GC Services Limited Partnership over claims that the debt collector sent her a misleading letter.
New York
A New York woman has filed a proposed class action lawsuit against GC Services Limited Partnership over claims that the debt collector sent her a misleading letter. The letter allegedly warned her that if she accepted a settlement offer, her creditor – Chase Bank USA, N.A. – may present her with “less favorable terms” or “deny [her] application” for future products. This language implies, according to the complaint, that if the plaintiff were to pay the full amount of the debt instead of settling, she would be more likely to be approved for credit in the future. The complaint claims, however, that this implication is false and was meant to coerce the plaintiff into paying the full balance in the notice.
