Class Action Accuses TruthFinder of Sending ‘Spam’ Text Advertisements Without Consent

TruthFinder has been hit with a class action over its alleged practice of sending spam advertisements via text message without first obtaining permission to do so.
Public records search company TruthFinder LLC has been hit with a proposed class action over its alleged practice of sending spam advertisements via text message without first obtaining permission to do so.
Per the case, the defendant has “negligently, knowingly, and/or willfully” violated the Telephone Consumer Protection Act by failing to obtain recipients’ consent before sending non-emergency text message advertisements by way of an automatic telephone dialing system (ATDS).
The plaintiff, a Houston, Texas consumer, says she received on November 14, 2018 the following text message from TruthFinder in an attempt to entice her into purchasing its services:
“Hi Maria Your Funding Application Approval on po box 891 – www.qlezrww.co/KOX9d3D”
Below the message was a duplicate internet link under the heading “Reveal Truth,” the suit says. When the plaintiff clicked on the link, she was directed to a website promoting TruthFinder’s goods and services, according to the case.
The lawsuit alleges the text message was placed from the phone number (832) 210-1864 via the defendant’s SMS Blasting Platform, an automatic telephone dialing system.
The plaintiff argues the defendant’s text violated the TCPA in that TruthFinder used an ATDS to send the message without obtaining prior express written consent to contact the consumer in such a manner.
