Citibank Hit with Class Action Over Alleged Robocalls to Wrong Numbers

A class action claims Citibank has placed unlawful robocalls concerning credit card accounts to consumers never provided prior consent to be contacted.
A proposed class action claims that Citibank, N.A. has placed unlawful robocalls concerning credit card accounts to consumers who are not customers of the bank and thus never provided prior consent to be contacted.
According to the 11-page case, Citibank’s practice of “repeatedly deliver[ing]” artificial or prerecorded voice messages to wrong or reassigned phone numbers violates the Telephone Consumer Protection Act (TCPA), a federal law that prohibits the use of automatic telephone dialing equipment to place certain types of non-emergency calls unless a caller has obtained a recipient’s prior consent to be contacted.
The plaintiff in the case is a Cleveland, Tennessee resident who claims to have received from Citibank at least 13 artificial or prerecorded voice messages that were intended for someone else.
For example, the suit says the plaintiff received the following two messages on March 21 and April 5, 2022, respectively:
“This is not a sales call. We look forward to speaking with you. Thank you. You may also access your account information online at www.toro-exmark.accountonline.com. This is Citibank with a message for [a consumer’s name] about your Toro Exmark credit card program. Please press pound at any time to continue to our automated payment system or call Citibank at 866-613-6856. This is not a sales call. We look forward to speaking with you. Thank you. You may also access your account information online at www.toro-exmark.accountonline.com.”
“Thank you for being a part of the Citibank family. We know you’re busy but if you could please just take a few minutes to login at the website for your retail credit card issued by Citibank to review your current status it would be appreciated. If you prefer to call us please feel free to as it is always great to get a chance to speak with one of our valued clients. Our toll-free number is 1-877-587-5727. Once again, thanks for being a valued Citibank customer.”
The lawsuit looks to cover anyone in the U.S. to whom Citibank placed a call in connection with a credit card account to a cell phone number not assigned to a Citibank customer or authorized user and which call used an artificial or prerecorded voice at any time from January 29, 2022 through the date of class certification.
