A proposed class action filed in California claims Citibank, N.A. violated the Telephone Consumer Protection Act (TCPA) by using an automatic telephone dialing system to call consumers’ cell phones and leave pre-recorded voice messages. The complaint says Citibank’s calls to the plaintiff, who never gave prior consent to receive any communications, concerned the closure of his Best Buy credit card account. Even though the plaintiff’s attorney faxed a cease and desist communication to the defendant, the robocalls persisted, the suit says.
