The 28-page proposed class action contends that the supposedly natural Chobani Zero Sugar yogurts in fact contain several synthetic ingredients, including stevia leaf extract, monk fruit extract and, in all flavor varieties except vanilla and toasted coconut vanilla, artificial coloring agents. In addition, the false advertising suit charges that the yogurts were made until recently with the synthetic additive citric acid.
The case challenges the all-natural ingredients claim featured on each Chobani Zero Sugar yogurt flavor, including, at least:
- Vanilla;
- Strawberry;
- Toasted Coconut Vanilla;
- Mixed Berry;
- Strawberry Cheesecake;
- Blueberry;
- Milk & Cookies;
- Key Lime Pie;
- Peach;
- Black Cherry;
- Raspberry;
- Rainbow Sherbet; and
- Lemon Meringue Pie.
Per the complaint, the yogurts’ labeling is misleading because the products are made with stevia leaf extract and monk fruit extract, two artificial ingredients whose natural sources have undergone significant industrial and chemical processing.
Moreover, the filing argues that the “Only Natural Ingredients” claim is deceptive because most flavors, aside from vanilla and toasted coconut vanilla, contain ingredients used as artificial coloring. According to U.S. Food and Drug Administration guidelines, any ingredient added to color a food is categorically unnatural to the product, the lawsuit says.
As such, the suit alleges the use of the term “natural” is misleading when used on a food product that contains added coloring agents, such as Chobani Zero Sugar yogurts.
The case charges that the allegedly false “Only Natural Ingredients” claim renders the yogurts misbranded under federal and state law.
The Chobani Zero Sugar yogurts lawsuit looks to represent anyone who, at any time in the past four years, purchased any of the products listed on this page within California for personal or household use, and not for resale.
