Hindsman et al. v. General Motors LLC

Two California Chevrolet owners have filed suit against the vehicle’s maker, General Motors LLC, claiming model year 2010 to 2017 Equinox vehicles contain a defect that can cause high oil consumption. According to the suit, drivers have complained that their cars burn through “abnormally high amounts of oil,” which the complaint notes “is unreasonably dangerous because it can cause engine failure while the [vehicles] are in operation at any time and under any driving conditions or speeds.” One plaintiff says he is forced to check his oil every few days and changes the oil every 2,000 miles. The other plaintiff claims he has added about 12 quarts of oil to his 2010 Equinox every year since he bought it.
The case argues that GM “actively concealed and failed to disclose” the alleged defect to consumers despite supposedly knowing of its existence since at least 2010. The complaint cites a Service Bulletin in which GM reportedly references the problem and provides instructions for how to address it. Nevertheless, the suit claims the car manufacturer hid the problem from consumers when they purchased or leased Equinox vehicles, subjecting them to significant harm. From the complaint:
“Had [the plaintiffs and proposed class members] known at the time of sale or lease about the Oil Consumption Defect and the associated costs and/or the safety hazards described herein, [they] would not have purchased the Class Vehicles or would have paid less for them.”
