Charter Communications Hit with Class Action Over Alleged Robocalls
Last Updated on May 8, 2018
Leeb v. Charter Communications, Inc.
Filed: November 28, 2017 ◆§ 4:17-cv-02780
Charter Communications, aka Spectrum, allegedly uses prohibited autodialers to place calls to consumers' cell phones without consent.
Charter Communications, Inc. (Spectrum) is the defendant in a proposed class action in which the plaintiff claims the company unlawfully places automated, unsolicited calls to consumers’ cell phones. Citing suspected Telephone Consumer Protection Act (TCPA) abuses, the complaint says the cable, Internet and telephone services giant is well aware of the TCPA’s prohibition on using autodialers and certain uses of pre-recorded voice technology in calls to consumers, yet places such calls anyway.
Specific to the plaintiff, the lawsuit claims the man received calls to his cell phone in October 2017 attempting to collect on a supposedly past-due account from someone named “Sara Price.” The man claims he never provided Charter with his cell phone number, and that an agent for the defendant admitted to him over the phone during one interaction that the calls were being placed via an autodialer.
