A proposed class action filed against CFS2 Inc. claims the company violated federal law (namely the Fair Debt Collection Practices Act) by calling consumers and leaving messages without identifying itself as a debt collector calling about collecting a debt. The complaint details allegations that the company called the plaintiff’s cell phone and left numerous messages that included a call back number, but did not specify the nature of the call or who was calling, behavior that can be viewed as harassing or deceptive to the least sophisticated consumer under the FDCPA.
The lawsuit claims the defendant intentionally did not identify itself as a debt collector calling about a debt in the messages. A debt collector doing so, the lawsuit argues, could lead the least sophisticated consumer to unwittingly provide personal information over the phone.
