New York
Central Credit Services LLC is the defendant in a proposed class action lawsuit that claims it misled a New York consumer as to the amount of his alleged debt. According to the complaint, the debt collector sent the plaintiff a letter that included his “total balance due as of the date of this letter” and noted that itemization of the amount “is subject to timing and system limitations.” The suit argues that the defendant implied in the above language that the plaintiff’s balance was increasing daily but failed to provide him with the information he needed to calculate how much he purportedly owed.
“The sole purpose of the Defendant’s statement…” the complaint reads, “was to coerce the Plaintiff into paying immediately.”
