New York
Central Credit Services LLC is on the receiving end of a proposed class action lawsuit that alleges the debt collector failed to fulfill its Fair Debt Collection Practices Act obligation to clearly specify the amount of a consumer’s debt. The plaintiff, a New York resident, says he received a collection notice from Central Credit Services stating that the “Amount Due” listed in the notice “reflects the total balance due as of the date of this letter” (emphasis added). The suit argues that the language in the defendant’s statement indicated the balance may change, but the letter allegedly contained no disclosure explaining whether the amount was increasing. According to the complaint, this supposed ambiguity deprived the plaintiff of his ability to calculate the true amount of his debt on any given day.
