CBV Collections, Inc. is facing a proposed class action lawsuit in Georgia that claims the debt collector violated federal law by threatening to take actions it did not intend to take.
CBV Collections, Inc. is facing a proposed class action lawsuit in Georgia that claims the debt collector violated federal law by threatening to take actions it did not intend to take. Specifically, the defendant allegedly sent a consumer a collection letter that stated the following:
“UNLESS I HEAR FROM YOU WITHIN 7 DAYS FROM TODAY THIS ACCOUNT WILL BE SENT TO OUR LEGAL DEPARTMENT FOR REVIEW.”
The suit argues that “there is no legal department associated with this debt collector or the alleged debt” and that the defendant never intended to sue the plaintiff. The statement, therefore, was a false threat meant to coerce the woman into paying off the amount in the letter, the complaint claims.
