CBM Services, Inc. is on the receiving end of a proposed class action lawsuit alleging that it violated the Fair Debt Collection Practices Act by demanding an unlawful collection fee and falsely threatening to contact a consumer at her workplace.
CBM Services, Inc. is on the receiving end of a proposed class action lawsuit alleging that it violated the Fair Debt Collection Practices Act (FDCPA) by demanding an unlawful collection fee and falsely threatening to contact a consumer at her workplace. The plaintiff in the case claims she received a collection letter from CBM Services informing her that she owed $128.56 to “ADVANCED DIAG IMAG PC-NEW,” $20.00 to “CMU MEDICAL EDUCATION PAR,” and a total balance of $168.56. The suit argues that the total amount contains an “arbitrary” $20.00 charge that is not explained in the letter and not authorized under the agreement between the plaintiff and her creditors.
The plaintiff further claims the letter informed her that the defendant “may be contacting [her] at [her] home or place of employment within the next few days.” The suit argues that this threat was intended to induce a false sense of urgency and fear in the plaintiff and was never carried out, which, according to the suit, is a violation of the FDCPA.
Note: The complaint misstates the name of the defendant as CMB Services, Inc.
