CBA of GA Inc., which does business as Credit Bureau Associates of Georgia, is the defendant in a proposed class action lawsuit that alleges the company charges unlawful collection fees. The plaintiff, a Georgia resident, claims she received a collection letter from the defendant in which the debt collector said it would charge a $2.00 “processing fee” for “each debit/credit card transaction processed through the mail or by phone.” The lawsuit argues that the “agreement creating the debt” did not authorize the defendant to tack on a processing fee, nor is there a law in Georgia that permits the added charge. Therefore, the plaintiff was harmed by “being asked to pay more money than she actually owed,” the case alleges.
