Cavalry Portfolio Services, LLC has been hit with a proposed class action claiming it failed to disclose to a consumer that the balance of her debt was increasing.
Cavalry Portfolio Services, LLC has been hit with a proposed class action claiming it failed to disclose to a consumer that the balance of her debt was increasing. The suit takes issue with a collection letter the defendant sent to the plaintiff in which it stated her “Outstanding Balance” but neglected to mention whether the amount would remain static or increase over time. According to the complaint, the plaintiff’s account was, in fact, subject to interest, late fees, and other charges, but because Cavalry omitted information such as the interest rate, date of accrual, and nature of the additional fees, the plaintiff was unable to calculate how much she needed to pay, the suit says.
