Cavalry Portfolio Services, LLC has been hit with a proposed class action lawsuit alleging the debt collector failed to identify the plaintiffs' creditors in collection letters it sent them.

Cavalry Portfolio Services, LLC has been hit with a proposed class action lawsuit alleging violations of the Fair Debt Collection Practices Act (FDCPA). Filed by two New York consumers, the suit claims the defendant sent debt collection letters that failed to clearly identify the plaintiffs’ creditors. The letters each allegedly identified an “original institution” but neglected to specifically name an entity as the original creditor, current creditor, or creditor to whom the debt was owed. Moreover, the case states the notices also failed to indicate who Cavalry represents and who referred the plaintiffs’ accounts to the defendant. According to the complaint, the plaintiffs, upon reading the letters, could interpret them in more than one way and would be unsure as to whether they should send payments to Cavalry or to the “original institution” named in the letters.
