Three consumers say they received notices from Cavalry Portfolio Services in which it failed to properly name the creditors to whom they owed payment.

Three consumers have put their names on a proposed class action against Cavalry Portfolio Services, LLC over materially identical collection letters sent by the defendant that allegedly failed to clearly and accurately identify the creditor to whom the plaintiffs’ debts are owed. The lawsuit says the plaintiffs each received a letter from Cavalry stating “RE: Original Institution” with no further explanation as to which particular entity referred the accounts to the defendant, nor details on who should receive payment.
“Even if a debt collector conveys the required information,” the lawsuit reads, “the debt collector nonetheless violates the [Fair Debt Collection Practices Act] if it conveys that information in a confusing or contradictory fashion so as to cloud the required message with uncertainty.”
