Cavalry Portfolio Services, LLC and Cavalry SPV I, LLC are on the receiving end of a proposed class action that claims the debt collectors threatened a consumer with actions the companies did not intend to take.

Cavalry Portfolio Services, LLC and Cavalry SPV I, LLC are on the receiving end of a proposed class action that claims the debt collectors threatened a consumer with actions the companies did not intend to take. The suit claims the defendants sent the plaintiff a collection letter that contained the following statements:
“As of the date of this letter, your account meets Cavalry’s guidelines for placement with one of Cavalry’s collection law firms practicing in your state. If you act within 30 days to resolve your account, your account will not be placed with a collection law firm.”
The complaint notes that although the plaintiff did not resolve her account within 30 days, the defendants never relinquished it to “a collection law firm.” Therefore, the case argues, the threatening language in the letter was “deceptive, misleading, and unfair,” meant only to coerce the plaintiff into making payments on her alleged obligation.
