A California man has filed a proposed class action lawsuit against defendant Carguardian Warranty LLC claiming the company violated the TCPA.
A California man has filed a proposed class action lawsuit against defendant Carguardian Warranty LLC claiming the company violated the TCPA by engaging in “intrusive telemarking campaigns.” According to the suit, Carguardian uses an autodialer to illegally place calls to consumers’ cell phones without their prior consent and attempts to sell them extended warranties for their vehicles. The plaintiff alleges that these calls are a “nuisance” and interrupt his privacy. He further claims that the defendant has been sued before over similar allegations. The suit seeks to cover the following proposed class:
“All persons within the United States who, within the four years prior to the filing of this Complaint, received a telephone call or text message made through the use of an automatic telephone dialing system and/or an artificial or prerecorded voice, from Defendant or anyone on Defendant’s behalf, promoting Defendant’s goods or services, to said person’s cellular telephone number, who had not expressly consented in writing to receiving such calls.”
