Capreit Residential Management, LLC is the defendant in a proposed class action in which the plaintiff claims the real estate operating company unlawfully contacted consumers through Short Message Service (SMS)—text messaging—in violation of the Telephone Consumer Protection Act (TCPA).
The case states that the plaintiff called one of the defendant’s phone numbers associated with one of its properties, the Minneapolis Grand Apartment Complex, and was prompted by a prerecorded message to press “2” if he wanted to decline receiving SMS text messages with marketing information. Despite pressing “2” during that call, the case says, the plaintiff allegedly received an unsolicited text from the defendant on the same day. According to the lawsuit, the text message in question was sent by way of an automatic telephone dialing system.
