A proposed class action was filed against Capital Management Services, LP after it allegedly sent a man a debt collection letter that he claims violated the Fair Debt Collection Practices Act.

A proposed class action was filed against Capital Management Services, LP after it allegedly sent a New York man a debt collection letter that he claims violated the Fair Debt Collection Practices Act (FDCPA). According to the suit, the letter listed the man’s “Current Amount Due” without providing any additional information about whether the amount would change.
“By stating a ‘Current Amount Due,’” the complaint reads, “Defendant falsely suggested that immediate payment of the balance would benefit Plaintiff by implying that the Balance would be subject to change, and could be subject to additional interest.”
