A proposed class action out of Texas federal court alleges Capella Education Company violated the TCPA by placing unauthorized calls to the plaintiff.
A proposed class action out of Texas federal court alleges Capella Education Company violated the Telephone Consumer Protection Act (TCPA) by placing unauthorized calls to the plaintiff.
According to the complaint, the defendant—which does business as online institution Capella University—“conducted wide scale telemarketing campaigns” consisting of unlawful phone calls to unwilling recipients.
The plaintiff, whose number was registered with the National Do No Call Registry, alleges she began receiving unsolicited calls “offering online education opportunities” from the defendant in 2016. The woman did not give the defendant prior express written consent to receive telemarketing calls, nor did she have any prior business relationship with the institution, the suit says. Further, the plaintiff claims she repeatedly requested to stop being contacted but continued to receive dozens of unlawful solicitations from the defendant.
