Calif. Driver Alleges Walmart Breached Lifetime Tire Balance, Rotation Contract by Shuttering Auto Care Centers in March 2020

A consumer claims Walmart's decision to shutter its Auto Care Centers in March 2020 deprived those who bought lifetime tire balance and rotation policies of using the service.
A California consumer who bought Walmart’s lifetime tire balance and rotation policy has filed a proposed class action against the mega retailer over its decision to shutter its Auto Care Centers in March.
According to the 18-page lawsuit, the plaintiff bought the lifetime tire balance and rotation protection, which promised said services every 7,500 miles for the life of qualified tires, in July 2018 based on the representation that Walmart would honor the terms of the policy through the lifetime of his tires. Instead, Walmart fell short of what was promised when the plaintiff was “refused service at multiple store locations” earlier this year, the suit says.
“By virtue of its failure and/or refusal to perform under the terms of the policy, Defendant’s representations were false and misleading,” the complaint says.
Though the lawsuit makes no mention of the coronavirus pandemic, the case argues Walmart’s failure to provide the services bargained for by those who bought the defendant’s lifetime tire balance and rotation policy amounts to a violation of California’s Consumers Legal Remedies Act in that the company failed to perform under the terms of the purchased policy, as well as issued “false representations, marketing and advertising to that effect…”
The breach-of-contract lawsuit looks to represent consumers nationwide who bought lifetime tire balance and rotation services from Walmart, as well as a California-only subclass.
