Cain Industries, Inc. is facing a proposed class action lawsuit claiming it sent unsolicited junk fax messages in violation of federal law.
A proposed class action filed over alleged Telephone Consumer Protection Act (TCPA) violations claims waste heat recovery and generator manufacturer Cain Industries, Inc. sent the plaintiff, a Georgia plumbing business, unsolicited junk fax messages. The case mentions a January 23, 2015 fax message allegedly sent by Cain Industries that the plaintiff claims it received despite never providing the defendant with express invitation or permission to send such faxes. Further, the message allegedly did not contain mandatory opt-out language.
