A California woman has filed a proposed class action against Alltran Financial, LP claiming the debt collector failed to clearly specify the amount of her alleged debt.
A California woman has filed a proposed class action lawsuit against Alltran Financial, LP claiming the debt collector failed to clearly specify the amount of her alleged debt in violation of the Fair Debt Collection Practices Act (FDCPA) and California state law. The plaintiff says she received a collection letter from Alltran that noted a balance of $10,024.42, but did not indicate whether the amount was subject to interest or other fees. The next month, she allegedly received another letter containing a balance that had increased to $10,218.43. The suit argues that the different balances reflect accruing interest or added charges, and that the defendant was required to disclose these fees under the FDCPA. According to the complaint, the lack of information in the collection letters leaves the unsophisticated consumer unable to determine the true amount of his or her debt, rendering the letters “misleading” and “deceptive.”
