C. Tech Collections, Inc. is facing a proposed class action lawsuit filed by a New York man who claims the defendant sent him a collection letter that misstated his debt dispute rights.
C. Tech Collections, Inc. is facing a proposed class action lawsuit filed by a New York man who claims the defendant sent him a misleading collection letter. According to the complaint, the letter stated two different dates – December 31, 2016 and January 3, 2017 – on which the notice was supposedly sent. As a result, the plaintiff says he was unsure as to when the 30-day validation period began during which he was permitted to dispute his alleged debt.
The letter also contained a statement informing the plaintiff that he should “MAIL ALL CORRESPONDENCE & PAYMENTS TO” a physical address, the complaint says. The suit claims the inclusion of an address indicates to consumers that disputes must be submitted in writing when the Fair Debt Collection Practices Act also allows for oral disputes.
