Florida’s Business Law Group, PA and The Enclave at Richmond Place Condominium Association, Inc. are the defendants in a proposed class action filed over alleged violations of the Fair Debt Collection Practices Act (FDCPA) and the Florida Deceptive and Unfair Trade Practices Act.
The plaintiff, who owns property in Hillsborough County, Florida, claims he was sent documents by the defendants that intentionally did not disclose that the debts from which the communication stemmed were time-barred by an applicable statute of limitations and were, therefore, uncollectable. Summarily, the suit later argues, it is against the law for debt collectors such as the defendants to assert the existence of a legal right to collect a debt when they are fully aware that the right to collect said debt no longer exists due to a statute of limitations.
