BMW Water Pump Lawsuit Filed Over Aug. 2024 Recall of More Than 720K Vehicles

BMW of North America faces a proposed class action lawsuit centered on an August 2024 recall of more than 720,000 vehicles equipped with a defective water pump that may pose a fire risk.

The 25-page BMW lawsuit relays that the automaker recalled hundreds of thousands of 2012-2018 vehicle models equipped with a water pump whose electrical connector was improperly sealed, which could allow water to collect on the plug connector and cause an electrical shortage. The BMW water pump defect could increase the risk of a “thermal event” and possibly a fire, the complaint states.
The filing relays that although BMW’s recall includes a free water pump and plug connector replacement and installation of a “protective shield,” these measures will cost hours of time for the plaintiff and other drivers, who the lawsuit contests are “burdened” with a devalued vehicle.
In addition, the case says, BMW drivers must expend time and money to transport themselves and tow their vehicles to a certified BMW mechanic to take advantage of the offered repairs.
“In all, Defendant’s Recall amounts to tens of thousands of hours and dollars needlessly taken from Plaintiff and other Class Vehicle owners,” the lawsuit argues.
The vehicle models involved in the August 2024 water pump recall include:
Car and Driver relays that BMW owners and lessees are “expected to be notified [about the recall] starting in early October.” The publication shares that the faulty BMW water pump’s electrical pump connector can allow water to drop from the positive crankcase ventilation system through the seal, possibly causing a short circuit.
The class action suit contends that there exists “no foreseeable reason for any of the individual parts to fail” and that the BMW water pump issue is the result of the automaker’s “improper engineering, design, or manufacturing.”
The BMW water pump recall lawsuit looks to cover all consumers in the United States who bought or leased a BMW 228I manufactured from 2014 through 2016; 228XI manufactured from 2014 through 2016; 328I manufactured from 2012 through 2016; 328XI manufactured from 2012 through 2016; 428I manufactured from 2014 through 2016; 428XI manufactured from 2015 through 2016; 528I manufactured from 2012 through 2016; X1 manufactured from 2012 through 2015; X3 manufactured from 2013 through 2017; X4 manufactured from 2015 through 2018; X5 manufactured from 2016 through 2018; or Z4 manufactured from 2012 through 2016.
