Blue Cross Blue Shield of Florida Hit with Class Action Over Allegedly Unauthorized Policy Cancelations

A lawsuit alleges Florida Blue terminated a consumer's insurance policy without authorization or explanation.
Blue Cross and Blue Shield of Florida is the defendant in a proposed class action filed by a consumer who alleges thousands of policyholders in the state have had their policies terminated or canceled without proper notice.
The lawsuit states the plaintiff had a policy with the defendant, doing business as Florida Blue, since January 1, 2017. The policy, the suit notes, was set to renew automatically, as well as accept automatic payments of insurance premiums. According to the lawsuit, the plaintiff submitted in November 2017 an application for a new Florida Blue policy, which was accepted by the defendant. Shortly thereafter, the case says, a computer glitch at Florida Blue required a number of policyholders to repeat the sign-up processes, including opting into automatic payments. The plaintiff’s policy, for which payment was withdrawn by Florida Blue in December 2017, was to provide coverage for herself and four family members, the lawsuit adds.
Jumping ahead to July 2018, the lawsuit states the plaintiff attempted to log into the defendant’s online portal but was unable to sign in. Upon contacting the defendant to reset her login credentials, the plaintiff was allegedly informed that her policy had been terminated as of May 31, 2018, and that Florida Blue would not be reinstating the policy.
“Florida Blue did not send notification of termination/cancellation in writing to [the plaintiff] until after the July 11, 2018 telephone call,” the suit alleges.
