BlackOxygen Ordered to Pay $7.5 Million in Toxic Supplements Lawsuit

The makers of BlackOxygen nutritional supplements were ordered by a federal judge to pay customers over $7.5 million in damages after the company lost by default a class action lawsuit that claimed the products contained unsafe levels of toxic heavy metals.

In a nine-page order, U.S. District Judge Leigh Martin May granted the plaintiffs’ supplemental motion for default judgment against defendants BlackOxygen Organics and Marc Saint-Onge, finding that the consumers had adequately alleged facts supporting claims that the BlackOxygen tablets and powders were negligently misrepresented as safe for human consumption.
The default judgment was issued on October 29, 2024 after the defendants failed to respond or present a defense in the case.

The Georgia federal judge also found that the defendants are liable for $7,554,603.59 in damages, excluding approximately $1 million in refunds already issued to consumers. According to the order, this figure represents the total amount a class of 62,051 customers spent purchasing the defendant’s products.
Class members include any United States resident who bought the BlackOxygen tablets and/or powders from November 19, 2019 through November 19, 2021, the order specifies.

The initial lawsuit against BlackOxygen alleged the supplements—which are made from mud extracted from Moose Creek Bog in Ontario, Canada—are “adulterated, unlawful, and worthless” because they contain undisclosed, dangerously high levels of toxic heavy metals.
