The 19-page Bestway lawsuit states that nearly 866,000 spa pumps were recalled on September 12, 2024 due to an apparent defect that can cause a pump to overheat and its plastic housing to ignite. The U.S. Consumer Product Safety Commission (CPSC) stated in its recall announcement that it was aware of at least three fires, one of which resulted in a fatality, linked to the faulty spa pumps, with seven other incidents reportedly involving the products under investigation.
The class action suit accuses Bestway of breaching the implied warranty of merchantability included with each sale of the recalled spa pumps, which circulate water through a spa or hot tub’s filtration, heating and jet systems, given that the products are not fit for their ordinary purpose and pose a fire and burn risk. The case alleges Bestway concealed, or failed to disclose, the true nature of the spa pump manufacturing defectsfrom consumers, who have been left with a “worthless and unsafe” product, causing economic injury.
“After all, Defendant did not indicate that the Recalled Spa Pumps would contain a hazardous overheating defect,” the complaint reads.
The CPSC has urged consumers to immediately stop using the AirJet and HydroJet spa pumps, some of which were sold with inflatable spa liners under the brand names SaluSpa, Coleman and Hydro-Force, and to contact Bestway for a free replacement pump. Alternatively, a consumer can request a refund of $100 for AirJet spa pumps or $189 for HydroJet spa pumps.
The spa pump recall includes only AirJet and HydroJet spa pumps bearing the model numbers P05332, P05339, P05711, P05807, P07000, P07001, P05511, P07034, and P07572, with “Bestway” and the model number printed on the label on the side or back of the pump.
Recalled units were sold between May 2021 and May 2024 for between $400 and $790 at retailers that include Amazon, Costco, Walmart, Sam’s Club and QVC.
