The owning entity of Berks Credit & Collections, Inc. has been hit with a class action claiming the company sent out illegal debt collection letters to NJ residents.
New Jersey
The owning entity of Berks Credit & Collections, Inc. has been hit with a class action claiming the company sent out debt collection letters to New Jersey residents that illegally included charges for collection fees. The plaintiff claims he received a collection letter that stated he owed two different total balances for $600 and $650. The $650 total balance, the lawsuit contends, included an undisclosed collection fee the plaintiff claims was illegally tacked on to his original debt by the collection agency. The contents of the letter, the lawsuit says, was designed by the defendant to be intentionally confusing to the unsophisticated consumer, who may not understand whether their balance owed included only the principal debt owed.
