Behr's Premium DeckOver resurfacer is the subject of another proposed class action alleging the product, despite claims of superior quality and durability, begins to fail after only a few weeks or months of use. The defendants – Behr Process Corp., Behr Paint Corp., MASCO Corp., The Home Depot, Inc., and Home Depot U.S.A., Inc. – allegedly market DeckOver as a “resurfacer” that offers a cheaper alternative to replacing an old deck or concrete surface. According to the complaint:
“Consumers who spend extra money to buy DeckOver at a premium price hope to avoid replacing the deck or surface and thereby save money, and they expect to devote less time and money to maintain the deck in the years that follow.”
The two named plaintiffs argue, however, that the product “deteriorates quickly within mere months of its application, and in some cases weeks.” As a result, consumers are forced to pay out-of-pocket to remove the coating or replace damaged surfaces, the suit alleges.
According to the complaint, the defendants have known about the alleged problems with DeckOver for years, yet continue to market and sell the product without warning consumers of its potential to fail. In fact, this case is one of three suits that have been filed this year over the supposed issue.
