The case claims the plaintiff received at least five texts from Bed, Bath & Beyond that the retailer supposedly sent without consent.
A proposed class action has been filed in Florida against Bed, Bath & Beyond Inc. over suspected violations of the Telephone Consumer Protection Act (TCPA). The plaintiff claims he received at least five unsolicited text messages from the New Jersey-headquartered company between December 2017 and January 2018. The case claims the plaintiff never provided the defendant with express written permission to contact him via text messages sent through an automatic telephone dialing system. According to the suit, the text messages offered mobile coupons and “constitute telemarketing because they encouraged the purchase of goods at Bed Bath & Beyond.”
