A proposed class action lawsuit has been filed against Barilla America, Inc. by a consumer who claims the company fraudulently advertises its pasta sauces as having “no preservatives” despite the presence of citric acid, a synthetic preservative. Barilla’s representations, according to the 25-page suit, are deceptive to consumers in search of healthier options.
Filed in Illinois, the case mentions specifically the following Barilla products that allegedly state on their labeling that they include “no preservatives”:
- Marinara Sauce;
- Tomato Basil Sauce;
- Mushroom Sauce;
- Spicy Marinara Sauce;
- Roasted Garlic Sauce;
- Sweet Peppers Sauce;
- Traditional Sauce;
- Chunky Traditional Sauce; and
- Tuscan Herb Sauce.
Citing potential violations of consumer protection laws in all 50 states and the District of Columbia, the lawsuit charges Barilla’s “no preservatives” claim is an attempt by the company to capitalize on consumer health trends.
