A class action case alleges Bariatrix and Setpoint Health sent unsolicited junk faxes marketing their weight loss/management products without consent.

Bariatrix US, Inc., which, along with two subsidiaries also named in this suit, markets and sells weight management/loss products, and Setpoint Health Corp. are the defendants in a proposed class action alleging the companies sent unsolicited “junk” fax messages to the plaintiff on at least four occasions in 2014. The plaintiff, a Cincinnati doctor’s office, alleges it never provided consent to the defendants before the companies sent the promotional faxes, which the case says did not contain legally mandatory opt-out language.
