A Georgia man claims in a proposed class action that an illegal background report furnished by Barada Associates Inc. with outdated and inaccurate information cost him a job opportunity.
According to the suit, the plaintiff applied for a job with non-party Leidos Health, who contracted Barada Associates Inc. to perform a background check on the man in November 2018. The report allegedly indicated that the plaintiff received five years of probation in 2009 following a first-time theft felony. Pursuant to the Fair Credit Reporting Act (FCRA), the case argues this information should not have appeared on the plaintiff’s report as the record was more than seven years old. The suit claims the man was ultimately denied employment due to the defendant’s “defamatory reporting.”
