A lawsuit claims Baptist Health and Baptist Sleep Centers sent junk faxes advertising their outpatient sleep study services without obtaining consent.

A proposed class action claims defendants Baptist Health South Florida, Inc. and Baptist Sleep Centers, LLC sent junk fax messages advertising their diagnostic sleep study services without obtaining prior consent to do so from recipients. The plaintiff company claims it’s received three unsolicited messages from the defendants that lacked opt-out language required by Telephone Consumer Protection Act (TCPA).
