Wright v. Genesis FS Card Services, Inc.
Filed: October 17, 2018 ◆§ 3:18cv2375
Credit card processor Genesis FS Card Services, Inc. is the defendant in a proposed class action that cites potential violations of the TCPA.
California
Credit card processor Genesis FS Card Services, Inc., which does business as Bankcard Services, is the defendant in a proposed class action that cites potential violations of the Telephone Consumer Protection Act (TCPA).
The suit alleges the company “incessantly” called the plaintiff multiple times a day in November 2016 to solicit his business. The plaintiff, who the case says was not and has never been a customer of the defendant, claims the calls violated the TCPA, as they were placed with an automatic telephone dialing system and without his prior written consent.
“Defendant’s calls interfered with Plaintiff’s work, annoyed and frustrated Plaintiff, distracted Plaintiff, and invaded Plaintiff’s privacy,” the case argues.
