A class action has been filed in New York against Bagel Boss claiming, among other Fair Labor Standards Act (FLSA) violations, the company failed to pay employees proper minimum and overtime wages and neglected to keep accurate records of hours worked. Filed by former delivery workers, the case also alleges the Manhattan bagel purveyor never notified employees that their tips were being included as an offset for wages. Additionally, the suit says, the defendant made delivery workers purchase bicycles, bike lights, and lock and chains with their own funds. Furthermore, one named plaintiff claims that in addition to the aforementioned allegations, he was never paid for his final 88 hours of work after leaving the bagel shop.
