Baer’s Furniture Settlement Resolves Lawsuit Over 2022 Data Breach

The Baer’s Furniture settlement, which received preliminary approval from the court on August 2, 2024, covers United States residents whose personal information was impacted by the Baer’s cybersecurity incident in or around August 2022.

Baer’s Furniture claim forms must be submitted online or by mail by December 16, 2024.
According to the official website, Baer’s Furniture class members may submit a claim for two years of credit monitoring, unreimbursed losses of up to $5,000 per person, lost time for up to $100 per person, or, in the alternative, a $50 cash payment in lieu of the foregoing benefits.
Claims for unreimbursed losses linked to the Baer’s data breach must be supported with documentation and include actual, documented losses “more likely than not caused by the Security Incident” and incurred after August 1, 2022. Unreimbursed losses include losses related to fraud or identity theft, attorney and/or accountant fees, and costs for credit repair services and freezing or unfreezing credit, the website states.
A final approval hearing for the Baer’s settlement is scheduled for December 5, 2024. It is typically after a class action settlement receives final approval from the court, and any appeals or objections are resolved, that benefits begin to go out to class members who filed a timely, valid claim.
The initial data breach lawsuit against Baer’s Furniture, filed in April 2024, alleged that the Pompano Beach, Florida home furnishings retailer negligently failed to protect current and former employees’ sensitive information.
Per the lawsuit, it was unknown for exactly how long the cybercriminals had access to Baer’s network before the intrusion was discovered, and the company, which has 16 locations across Florida, allegedly had no effective means of stopping, preventing or mitigating the data theft, which it reportedly discovered on August 21, 2022.
Current and former employees’ full names, addresses, Social Security numbers and potentially medical information were exposed in the Baer’s Furniture data breach, the suit claimed, noting that the “incredibly active and successful” ransomware gang BianLian claimed responsibility for the attack.
