According to the 28-page case, the New York State Department of Agriculture and Markets issued an alert in June 2024 warning consumers about lead contamination in Badia ground ginger and ground cinnamon. The presence of lead in the products was also confirmed by independent testing, the complaint says.
The lawsuit against Badia, which comes on the heels of another class action suit filed last month over alleged lead contamination in the manufacturer’s cinnamon powder, contends that consumers are led to believe the spices are safe and free from dangerous substances because there is no warning on product packaging about the possible presence of lead. Per the filing, lead exposure can cause cognitive deficits and increase the risk of mental illness, dementia, hypertension, arrhythmia and breast cancer.
The lawsuit argues that this flies in the face of Badia’s health-conscious representations that it produces “only the finest quality spices” and that its ground ginger and ground cinnamon are “Kosher,” “Gluten Free,” “Halal,” “MSG-free” and contain no known allergens.
“Listing all of these health-conscious claims would be interpreted by any reasonable consumer as a guarantee that the products can be trusted to be safe for consumption and not to contain substances that are harmful such as lead,” the suit asserts.
As the case tells it, consumers would not have purchased the spices at issue had they known the products risked containing the dangerous neurotoxin.
The complaint alleges that Badia ground ginger and ground cinnamon are “in no way safe for human consumption and are entirely worthless.”
The lawsuit looks to represent anyone who purchased Badia ground ginger or ground cinnamon in the United States at any time during the applicable statute of limitations period.
