AWA Collections is facing a proposed class action in which a California woman claims the debt collector failed to clearly identify her alleged creditor in a collection letter.
AWA Collections is facing a proposed class action in which a California woman claims the debt collector failed to clearly identify her alleged creditor in a collection letter. The August 2017 letter supposedly listed a “client name” as “Automobile Club” but provided no further information as to whom the purported debt was owed. According to the lawsuit, there is no existing entity by the name of “Automobile Club,” and an online search of the name turns up “hundreds of names of companies including the term.”
Further, the case claims the defendant added to the confusion by referring to Automobile Club as a “client” and failing to specify any entity as the woman’s “creditor.”
The plaintiff argues that upon reading the letter, she was unsure as to the identity of “Automobile Club” and could not determine whether the supposed debt was legitimate.
