A proposed class action filed over alleged “systemic civil rights violations” claims Derossi Global LLC, which operates 17 Avant Garden restaurants nationwide, unlawfully discriminates against blind individuals who attempt to access the website for its New York City location, Avartgardennyc.com. Citing potential Americans with Disabilities Act (ADA) abuses, the 27-page lawsuit claims the defendant’s website contains unlawful access barriers that make it “difficult, if not impossible” for blind users to navigate the online property. The case mentions Avantgardennyc.com allows users to, among other functions, browse menu descriptions and prices, buy gift certificates, and find locations.
“[The plaintiff] has made numerous attempts to purchase a gift card on Avantgardennyc.com, most recently in May 2017, but was unable to do so independently because of the many access barriers on the defendant’s website,” the lawsuit claims. “Additionally, [the plaintiff] was unable to find the location on [the defendant’s] website, preventing him from going into the physical location.”
