A California consumer alleges in a proposed class action that defendant Australian Gold, LLC’s label claims that its Gold Spray Gel with Instant Bronzer is a “Product of U.S.A.” are not entirely truthful—or in step with state law.
Citing a California Supreme Court ruling on labels that boast that a product was “Made in U.S.A.,” the lawsuit alleges that the defendant’s Gold Spray Gel with Instant Bronzer is, in truth, comprised of foreign ingredients obtained outside the United States that constitute “more than 10 percent of the final wholesale value of the product,” a violation of state consumer protection statutes.
“Consumers generally believe that ‘Made in U.S.A.’ products are of higher quality than their foreign-manufactured counterparts,” the 25-page suit states. “Due to [the defendant’s] scheme to defraud the market, members of the general public were fraudulently induced to purchase Defendant’s products at inflated prices.”
