The company behind the Formula 1 Heineken Silver Las Vegas Grand Prix and a contractor have been hit with a proposed class action on behalf of attendees of a practice session that was effectively canceled when a loose manhole cover damaged two racecars.

The nine-page lawsuit says Formula 1 owner Liberty Media Corporation has not offered refunds to any of the approximately 35,000 attendees who purchased tickets for the failed event, during which the drivers in the main Formula 1 race were to run practice and qualifying laps. Ticket prices ranged from several hundred dollars to tens of thousands of dollars, the suit relays.
Roughly nine minutes into the practice session, which was held at 8:30 p.m. on November 16, 2023, a drain cover came loose on the track and caused damage to two cars, stopping the race immediately, the case describes. The event was postponed for several hours and did not restart until 3:30 a.m., the complaint states. However, the filing shares, none of the attendees were allowed to watch it live because they were “escorted off of the property” at 1:30 a.m.
According to the lawsuit, Nevada-based co-defendant TAB Contractors, Inc. was responsible for ensuring the manhole cover was secure and the track was “race-ready.”
The suit alleges that as a result of the defendants’ negligence, event attendees suffered damages and are entitled to refunds of out-of-pocket expenses incurred in connection with traveling to and attending the canceled practice.
Per the case, the tickets provided that if the event was canceled and not rescheduled for any reason, the buyers would “receive a refund of up to the ticket’s face value as set by the Promoter.” However, as of the date of the filing, no offer of reimbursement has been made, the complaint says.
The lawsuit looks to represent any individuals who purchased tickets for and attended the Formula 1 practice run event and suffered damages as a result.
