Attain Med, Inc. is on the receiving end of a proposed class action lawsuit that claims it violated the Telephone Consumer Protection Act (TCPA) by sending unsolicited fax advertisements. The plaintiff in the case, a Michigan healthcare provider, alleges it received a fax from the defendant advertising goods and services when it had “no prior relationship” with the company and had not consented to receive the fax. The suit claims the message was “part of a mass broadcasting of faxes” and was illegal under the TCPA.
