Filed: November 11, 2016 ◆§ 1:16-cv-06279
A third class action lawsuit has been filed against a debt collection agency today, this time against Atlantic Recovery Solutions, LLC.
New York
A third class action lawsuit has been filed against a debt collection agency today, this time against Atlantic Recovery Solutions, LLC over its practice of allegedly leaving messages on debtors’ cellphones without properly stating that it is a debt collector calling about recovering a debt, a violation of the Fair Debt Collection Practices Act (FDCPA). According to the complaint, the defendant left the plaintiff numerous voice messages without identifying itself as a debt collector, which, the lawsuit argues, could cause the unsophisticated consumer to unnecessarily disclose personal information simply to find out the purpose of the messages.
