Asurint is facing a proposed class action over claims that the consumer reporting agency cost the plaintiff a job by publishing an inaccurate background check on the woman.
According to the case—which lists Asurint’s legal name, One Source Technology, LLC, as the defendant—the plaintiff was hired by non-party Proper Polymers in January 2018. Later that month, the defendant allegedly provided the employer with a misleading background report that included the plaintiff’s 2003 larceny and burglary convictions, charges that were reportedly expunged in 2014. The suit says the plaintiff’s employer, after receiving the allegedly inaccurate report, promptly terminated her employment.
The case argues the defendant failed to ensure the maximum possible accuracy of its report before publication. From the complaint:
“Defendant could have and should have checked South Carolina’s electronic case records prior to issuing the initial report. If it had done so, it would have discovered that the records of Plaintiff’s cases were no longer accessible, because they had been expunged. However, it did not check the records, and reported Plaintiff’s cases without verifying them by checking South Carolina’s electronic case records. Because Defendant did not take those steps, Plaintiff lost her job.”
Worse yet, the suit claims the defendant reported the plaintiff’s charges “multiple times on the same report,” making her background “look much worse than it was.”
